WEBSITE OWNERSHIP

The website http://www.ieseinsight.com ("the WEBSITE") and the brand, IESE INSIGHT, are the property of the Estudios y Ediciones IESE, S.L., registered in Barcelona, Spain, at Avenida Pearson 21, with the Tax Identification Number (Código de Identificación Fiscal) of B-58364753.

USERS

Access to and/or use of the IESE INSIGHT WEBSITE constitutes the condition of USER. The USER, by accessing the WEBSITE and/or using it, accepts the General Conditions of Use reflected in this Legal Notice. These conditions shall apply independent of the Contracting General Conditions, which are also binding.

USE OF THE WEBSITE

All contents included in the IESE INSIGHT WEBSITE, including the navigation architecture, databases, services, graphics, videos and other contents and/or sensory stimuli that make up the WEBSITE ("the CONTENTS"), belong to IESE INSIGHT and/or to a third party that has ceded rights to IESE INSIGHT.

The USER assumes responsibility for using the WEBSITE. This responsibility extends to the register that the USER needs to pass through in order to gain access to certain contents or services. In that register, the USER is responsible for giving truthful and lawful information. In registering, the USER provides a password for which the USER is responsible, undertaking to make diligent and confidential use of it.

The USER undertakes to make good use of the contents and services offered by IESE INSIGHT through its WEBSITE, in accordance with the current General Conditions of Use, and to not use the contents and services to commit, without limitation, illicit, illegal or malicious activities. In no event shall IESE INSIGHT be held responsible for any fraudulent use by the USER regarding the contents of the WEBSITE.

INDUSTRIAL AND INTELLECTUAL PROPERTY

The USER recognizes and accepts that all the industrial and intellectual property rights regarding the contents and/or any other element inserted in the WEBSITE (including, but not limited to, all the elements that make up the visual appearance, graphic image and other sensory stimuli of the different webpages of the WEBSITE, that is, the "look and feel," brands, logotypes, trade names, texts, reviews and comments, images, graphics, designs, sounds, databases, software, flowcharts, presentation, navigation architecture, as well as the source codes of the different webpages) belong to IESE INSIGHT and/or to a third party that has ceded its rights.

For that purpose, we consider WEBPAGES all those creations included and expressed by any means and/or tangible or intangible medium, known or unknown, which are the object of protection under the current regulations in force regarding industrial and intellectual property rights.

The total or partial visualization, printing, downloading or temporary storage of the contents and/or elements inserted in the WEBSITE, or in the pages that make it up, is permitted, provided it is for a personal, private or non-commercial use and the origin and/or author is mentioned or, failing that, the copyright symbol and/or notes of industrial property of IESE INSIGHT are clearly legible.

In no case does access to the WEBSITE imply any kind of permission, relinquishment, transmission, or total or partial assignment of said rights by their owners, except where express requisite authorization has been granted. These General Conditions of Use of the WEBSITE do not confer USERS any other right different from those foreseen and expressed in this Legal Notice to use, alter, exploit, reproduce, distribute or diffuse publicly the WEBSITE and/or the contents. Any other use or exploitation of any right is subject to the express prior written permission from authorized personnel of IESE INSIGHT and/or any applicable third-party rights holder.

It is strictly forbidden to use any elements, including total or partial reproduction, distribution and/or diffusion, for commercial purposes. It is also strictly forbidden to change, alter, dismantle and/or in any other way manipulate or exploit the WEBSITE, its pages and/or the contents inserted in them. These misconducts could give rise to the exercise of whatever legal or extrajudicial action may concern IESE INSIGHT in the exercise of its rights.

EXCLUSION OF GUARANTEES AND RESPONSIBILITIES

In no event shall IESE INSIGHT be held responsible for damages of any nature that might arise from errors or omissions in contents, lack of availability of the WEBSITE, or transmission of viruses or malicious or damaging programs in the contents, despite taking all necessary technological measures to avoid them.

LINKS

If, in the WEBSITE, there are links or hyperlinks to other sites on the Internet, IESE INSIGHT will not exercise any control over those sites and contents. In no event shall IESE INSIGHT be held responsible for the contents of any link belonging to someone else's website. IESE INSIGHT will not guarantee the technical availability, quality, reliability, accuracy, range, veracity, validity and constitutionality of any material or information contained in any of those hyperlinks or other sites on the Internet. Likewise, the inclusion of these external connections does not imply any association, merger or participation with the entities connected.

USERS will be able to make links or hyperlinks to the IESE INSIGHT WEBSITE provided that they fulfill the following criteria in accordance with these General Conditions of Use and the applicable laws. All websites or services linking to the IESE INSIGHT WEBSITE must fulfill the following conditions:

· It is allowed to link to pages of IESE INSIGHT where it is not necessary to register.

· The link must not imply, and must not be open to misinterpretation, that IESE supports or endorses the products, services, website or titleholder of the linked website.

· It must not falsify, distort or alter the true relationship, if one exists, with IESE INSIGHT or present wrong information about IESE INSIGHT.

· The linking website must not infringe any intellectual property right, or any right of any other nature, or break any legal requirement announced by the legislation currently in force.

· The sites, services or products must not have any content opposed to moral or public order. Moreover, that content must not be defamatory, illegal, obscene or offensive.

IESE INSIGHT reserves the right to protect its own interests if the above mentioned terms and conditions are broken, and IESE INSIGHT could order, if necessary, that the link be eliminated.

We hereby inform you that we use cookies with the sole purpose of shaping and improving our relationship with the USER and adapting to the technological aids of the USER. RIGHT OF EXCLUSION

IESE INSIGHT reserves the right to refuse or withdraw access to the WEBSITE and/or services offered without prior notice, at the initiative of itself or a third party, to any USER who breaches these General Conditions of Use.

CHANGE AND VALIDITY OF THESE CONDITIONS

IESE INSIGHT can modify these conditions at any time, being duly disclosed in the present notice. The validity of such conditions will depend on their exhibition, and they will be valid until they are modified by other conditions duly disclosed.

APPLICABLE LAW AND JURISDICTION

The relationship between IESE INSIGHT and the USER is subject to current Spanish regulations. To resolve any controversy or dispute, both parties submit to the Junta Arbitral de Consumo de Cataluña (Consumer Arbitration Board of Catalonia), which is in charge of designating the arbitrator or arbitrators and managing the arbitration process. If arbitration is not executed by joint agreement or is declared null and void, or when findings need to be executed, both parties will submit to the courts and tribunals of Barcelona, relinquishing expressly their own jurisdiction if necessary.
